TERMS AND CONDITIONS (“TERMS”)

These Terms of Service (“Terms”) govern your use of michaeljamin.com and related services, products, educational content, workshops, events, digital courses, memberships, communications, and merchandise (collectively, the “Services”).

The Services are operated by 3 Girls Jumping Inc, doing business as Michael Jamin (“Michael Jamin,” “we,” “us,” or “our”).

By accessing, purchasing from, registering for, or using the Services, you agree to these Terms.

Educational Content; No Guarantees

Michael Jamin provides educational content, creative guidance, workshops, and related materials. The Services are for informational and educational purposes only. We do not promise employment, representation, publication, commercial success, creative outcomes, income, or any particular result.

Your results depend on your own efforts, skills, experience, decisions, and circumstances.

Purchases and Payment

You agree to provide accurate, current payment and contact information. Prices, applicable taxes, payment schedules, and material terms of an offer will be displayed before purchase.

We may use third-party payment processors, including Stripe. We do not store complete payment-card information.

We may refuse, cancel, or limit an order where permitted by law, including for suspected fraud, pricing or availability errors, or violation of these Terms.

Digital Products, Immediate Access, and Refund Policy

Digital products—including digital courses, downloadable materials, recordings, and online educational content—are consumable products delivered through immediate access, streaming, downloading, account access, or another electronic method.

When you purchase a digital product identified as providing immediate access, you request and consent to immediate delivery or performance. Once access to the digital product has been granted, the product is considered delivered and cannot be returned.

Except where required by applicable law or where we are unable to provide the purchased digital product after reasonable efforts to resolve the issue, all sales of digital products are final and non-refundable once access has been provided.

Nothing in these Terms limits any non-waivable consumer rights that apply in your jurisdiction.

Payment Plans

Where a checkout page clearly identifies a payment plan, you agree to purchase the product for the total price shown at checkout and authorize the stated installment payments on the schedule presented before purchase.

A payment plan is a commitment to pay the full stated purchase price in installments; it is not a cancellable subscription unless the checkout page expressly states otherwise. Cancellation, non-use, or failure to complete the course does not eliminate amounts already due or remaining installments for the completed purchase, except where required by applicable law.

Subscriptions and Automatic Renewals

If we offer a subscription, membership, recurring plan, free trial, or automatically renewing service, its renewal terms, charge amount, frequency, and cancellation method will be clearly displayed before enrollment.

You may cancel a recurring subscription through the method provided at enrollment or by contacting support@michaeljamin.com. If you enroll online, you will be provided an online cancellation method where required by law.

Cancellation stops future recurring charges but does not automatically create a refund for charges already processed, except where required by law or expressly stated in the applicable offer.

Merchandise and Live Events

Physical merchandise, live events, and event tickets may be subject to product-specific return, exchange, cancellation, attendance, transfer, and refund terms disclosed before purchase. If there is a conflict between these Terms and a product-specific policy, the product-specific policy controls for that purchase.

Chargebacks and Payment Disputes

If you have a question about a charge, access issue, or purchase, please contact support@michaeljamin.com before initiating a payment dispute. We will make reasonable efforts to address legitimate concerns.

Nothing in these Terms limits your right to dispute an unauthorized charge or to exercise rights available under applicable law or your payment-card agreement.

Where a payment dispute is initiated, we may provide the payment processor and relevant financial institution with information reasonably necessary to respond, including the order record, checkout disclosures, version of these Terms and refund policy accepted, acceptance timestamp, IP address, payment authorization, account-access records, download or viewing records, communications, and proof of delivery.

SMS and Email Communications

Marketing SMS and email communications are sent only in accordance with applicable law and your communication preferences.

Marketing SMS consent is optional and is not a condition of purchase. If you opt in to SMS marketing, you consent to receive recurring automated marketing messages from Michael Jamin, operated by 3 Girls Jumping Inc. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help.

Your mobile number and SMS opt-in consent will not be shared with third parties or affiliates for their marketing or promotional purposes.

You may unsubscribe from marketing emails using the unsubscribe link in the message. Transactional communications may still be sent when necessary to complete a purchase, provide access, respond to a request, or comply with law.

Carriers are not liable for delayed or undelivered messages.

Intellectual Property

The Services, including videos, courses, recordings, text, graphics, materials, trademarks, and other content, are owned by or licensed to 3 Girls Jumping Inc and are protected by intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use purchased digital content for your own personal, non-commercial use. You may not copy, reproduce, publish, distribute, sell, share, sublicense, publicly display, record, scrape, reverse engineer, or create derivative works from the Services without prior written permission.

You may not share login credentials, course access, downloads, or paid materials with another person.

Unsolicited Materials

Do not submit unsolicited screenplays, story ideas, pitches, treatments, creative concepts, or other creative materials to us unless we expressly request them in writing. We are not obligated to review, return, compensate you for, or keep confidential any unsolicited material, subject to applicable law.

Acceptable Use

You may not use the Services unlawfully, interfere with the website or other users, attempt unauthorized access, submit false information, evade payment obligations, or use the Services to infringe another person’s rights.

We may suspend or terminate access for conduct that violates these Terms or threatens the security, integrity, or lawful operation of the Services.

Disclaimers

The Services are provided on an “as is” and “as available” basis, except where prohibited by law. We do not guarantee uninterrupted availability, error-free operation, or that content will meet every individual expectation.

To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, 3 Girls Jumping Inc and its officers, directors, employees, contractors, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity.

Where liability cannot be excluded, our total liability for a claim arising from the Services will not exceed the amount you paid to us for the specific product or service giving rise to the claim during the 12 months before the event giving rise to liability.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless 3 Girls Jumping Inc and its officers, directors, employees, contractors, and licensors from claims, damages, losses, liabilities, and expenses arising from your violation of these Terms, unlawful use of the Services, or infringement of another person’s rights.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Nothing in these Terms deprives you of mandatory consumer protections that apply in your place of residence.

Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Material changes will apply prospectively unless otherwise required by law.
